Obtaining Land
 

1.  For enterprises with foreign investment, the form of offering land will be determined according to the nature of project. Those conforming to category of land allocation will be allocated with the required land, and those not conforming can use land on a paid basis, mainly in the following forms: (1) letting out; (2) leasing; and (3) as equity contribution and shares from the Chinese partner.

2.  Enterprises with foreign investment can proceed as follows when using the original allocated land of the Chinese partner: (1) the Chinese partner can first let the land out, then transfer or lease it to the enterprise with foreign investment: (2) the land can be used as shares or equity contribution to the enterprise with foreign investment after the Chinese partner letting out the land; and (3) the government can directly let out or lease the land to enterprises with foreign investment.

3.  When enterprises with foreign investment need additional land for construction, the land management authority will offer the land as required, and for investing in operational projects such as commerce, touring, entertainment, banking and real estates, land must be offered in the form of bidding, auction or at indicated prices.

4.  The land use right obtained by Chinese partner by land letting out can be transferred, leased and mortgaged, or be used for other economic activities permissible by law; the land use right obtained via allocation must not be transferred, leased, mortgaged or used for other economic activities without approval. The land use right obtained by enterprises with foreign investment according to law shall be protected by state laws
